Charleston, W.Va. (AP) -- The mother of a man fatally shot by police during a chase is suing the city of Charleston.

Patricia Harrison's lawsuit contends that police should have stopped the chase and shouldn't have fired their weapons.

The lawsuit claims officers negligently opened fire on Harrison's son, Brian Good.

Police have said Good was fatally shot on Sept. 13 after he led officers on a brief chase following a hit-and-run.

Charleston patrolman Jerry Jones was killed by friendly fire during the incident.

Harrison's lawyer, Harold Albertson, says they believe police didn't follow procedures.

Mayor Danny Jones says the city is ready to go to court and he has no interest in settling the case.
