CCMH Petition Denied

A state Supreme Court ruling reaffirmed a Circuit Court decision that Camden-Clark Memorial Hospital should pay the legal costs for a family that brought a malpractice suit against the hospital.
The West Virginia Supreme Court of Appeals voted February 28th to refuse CCMH's petition that said that the hospital had done nothing wrong.
The original order from Judge Robert Waters in Wood County Circuit Court granted the family of Hilda Boggs more than $1.3 million in legal fees.
In March of 2006, the Boggs family was awarded $6.5 million in the malpractice suit--$3 million of which were for punitive damages.
In December, CCMH filed an appeal with the US Supreme Court to review the $3 million in punitive damages.
That case is pending.
