Brian Merritt Was sentenced Wednesday on 5 total counts of fraudulent use of an access device, also known as a credit card, and 2 counts of attempted fraudulent use of an access device.

In 2007 authorities said Merritt used his father's county credit card to make hundreds of dollars worth of purchases.

He was sentenced to 1-10 years in prison with credit for 322 days on 3 counts of fraudulent use of an access device. Also 1-10 years in prison with no days credit for 2 additional counts of fraudulent use of an access device. Also 1-3 years in prison for 2 counts of attempted fraudulent use of an access device with no days credit.

Merritt's attorney's office says Merritt will be behind bars for one year and then he'll have the possibility of parole. Once he is out of jail he will be under 5 years supervised probation.

Merritt must also pay back nearly $700 in court costs and $2,000 in court fees.

He shouldn't have done it (use the credit card)...it's wrong, and he needs to pay for his actions. BUT, child abusers and molesters are running free. Did he get a heavy sentense because his dad is sheriff? He didn't physically hurt anyone. With prisons as crowded as they are, I say give him community service, etc. but 1-10 years is a little too much.
