A Pleasants County man will now have to wait 4 more months behind bars before his sentencing.
Back in June, a jury found Richard Poore guilty of first degree murder.
Two years ago Poore was charged with the murder of his three-month old son, Richard "Ricky" Poore Jr., in 1981, after the child was found dead in Poore's home.
Poore's sentencing was set for Tuesday, but recently hired a new attorney who has requested a continuance to familiarize himself with the case, he has also motioned for a new trial.
"If a judge were to find that there are appropriate grounds to grant a new trial, then the matter will be rescheduled for a trial and his guilty verdict will be set aside from the first trial and we'd start brand new, as if nothing has ever occurred, basically from square one," says Timothy Sweeney, Pleasants County Prosecuting Attorney.
Poore's sentencing and possible hearing for a new trial has been rescheduled for December 29th.
