A "Substantial Risk" Of Murder

Much of the final day of testimony in the Jason Berecz trial Friday, was about the actions of Washington County Sheriff's Deputies the night of April 7th.

Particularly that of Sgt. Scott Parks, the deputy prosecutors say Berecz shot...and, according to medical experts, nearly killed...during the night-long standoff.

Sgt. Parks was shot in the right side of the face after officers were called to the residence of Berecz' mother that night. Parks, who testified Wednesday, survived. But a medical responder said it could have been a different story.

"If it had gone back a quarter-inch, a half an inch, or an inch," said Mark Fisher, "we could have been talking about a different set of circumstances."

A neighbor and regular acquaintance of the defendant says he had acted strangely earlier in the day of the incident.

"It seemed to me he was on something besides alcohol," said Melvyn Sliker. "His eyes were real faulty, and the way he was acting was stranger than I've seen him before."

Berecz was finally apprehended in the early morning hours of April 8th. But while he eventually gave himself voluntarily, police say he was tazed.

Sheriff Larry Mincks says it's unusual for shots to be fired inside a home during a domestic dispute, although it has happened in Washington County. Mincks says Sgt. Parks is being commended for his response to the situation.

"A panel of police officers not only determined he acted appropriately," Sheriff Mincks testified, "he was awarded the Ohio Attorney General's Distinguished Medal of Valor."

Sheriff Mincks says that honor is to be awarded Parks next Tuesday...which could be right after the trial ends.

Both the prosecution and defense rested Friday...the defense doing so without calling witnesses.

Closing statements in the trial are expected to begin Monday morning.
