A Wood County man arrested a year and a half ago after the death of his 14-month old son entered a guilty plea Thursday morning.
26-year-old Carl Sams was arrested in December of 2007 following the death of his 14-month-old son Devon.
Thursday Sams said Devon was crying while he was playing video games and he got frustrated with the baby and shook him.
Officials say the West Virginia state medical examiner concluded Devon died of a brain injury from shaking.
Sams had been charged with murder and death of a child by guardian or custodian. Thursday he pleaded guilty to the second count in order to have the murder charge dropped.
Jason Wharton, Wood County Prosecutor says: "Really from my first involvement in the case, taking everything into consideration it appeared that count two of the indictment was really what the defendant did in this case."
A September 14th hearing has been set for the court to decide whether or not to accept today's plea agreement.
If the plea agreement is accepted Sams faces 10 to 30 years in jail. He remains in the North Central Regional Jail.
