A Washington County man accused of killing his father-in-law has been indicted with aggravated murder.

A Washington County man accused of killing his father-in-law has been indicted with aggravated murder.

Gerald Smith has been formally charged with aggravated murder, two counts of aggravated burglary, two counts of aggravated robbery, tampering with evidence, and three grand theft charges.

In June 49-year old Smith was arrested for allegedly killing his father-in-law Homer Rogers.

Washington County Assistant Prosecutor Kevin Rings said based on evidence, they believe Smith used a knife to kill Rogers and then left in the victim's truck with a gun from the house and cash that Rogers had on him.

Rings says he believes the case does not meet the criteria for the death penalty.

Smith remained in jail Thursday.

Brandon Marino was indicted in connection to the alleged burglary and rape of a Marietta College student in February of 2009.

Marino was indicted on aggravated burglary, rape, and sexual battery.

He is currently being held at the Hamilton County Justice Center on an unrelated burglary charge.

The Washington County grand jury handed down these indictments Thursday:

Eric Edgar- Failure to Provide notice of Change of Address

Brian M. Taylor - 2 Counts of Failure to Comply with Order or Signal of a Police Officer, Receiving Stolen Property

Jason Corp- Failure to Appear

Joseph Camden- 2 Counts of Felonious Assault

Chester Morris- Theft, Breaking and Entering

Quintin A. Ramirez- Vehicular Assault

Carl M. Crislip- Grand Theft

Gerald A. Smith- Aggravated Murder, 2 Counts of Aggravated Burglary, 2 Counts of Aggravated Robbery, Grand Theft of a Firearm, Grand Theft of a Motor Vehicle, Grand Theft from an Elderly Person or Disabled Adult, Tampering with Evidence

Jason E. Wheeler- 2 Counts of Domestic Violence

Brandon Marino- Aggravated Burglary, Rape, Sexual Battery

Jason A. Lauderman- 2 Counts of Felonious Assault, Aggravated Burglary
