WV Law Offers Grace to Some People Arrested for First Offense DUI
WTAP News Some people arrested for their first offense of driving under the influence in West Virginia now have an opportunity to get the charge wiped from their record.

Some people arrested for their first offense of driving under the influence in West Virginia now have an opportunity to get the charge wiped from their record.
Attorneys say if someone is charged with DUI and his or her blood alcohol tests are between .08 and .15, didn't cause an accident, weren't fleeing from police, don't have a commercial license, and don't have any prior convictions then the person is eligible for a deferral program.
The person must tell the court he or she wants to do this within 30 days of arrest.
Attorney George Cosenza said "You lose your driving privileges for 15 days. You then go on what we call the blow and go, the test lock program, where you install that in your vehicle. It's rather expensive but you put it in your vehicle and before the vehicle will start you have to blow into the machine."
The interlock program is reportedly a minimum of 165 days long.
If you successfully complete it, the criminal charges would be dismissed and can later be expunged from your record.
