Aguements were heard Thursday about the inclusion of of a diary by the late wife of David Wayne Kaufman in Kaufman's upcoming trial...
Kaufman is accused of killing his wife, Martha Ann, last December.
His attorney argues that diaries Mrs. Kaufman kept just prior to her death should not be admitted into evidence in Kaufman's scheduled September 22nd trial.
"Some of which are prejudicial to Mr. Kaufman," said Attorney George Cosenza, "cannot come in without the opportunity for Mr. Kaufman to have cross-examined the author of those statements."
"The diary by Mrs. Kaufman is a present-sense impression," Assistant Wood County Prosecutor Pat Lefebure replied. "A present-sense impression, a present state of mind is a permanent state exemption."
Attorney Cosenza added the Kaufman children should not be allowed to testify about statements their mother made to them regarding David Kaufman's actions prior to her death.
There was no ruling made Thursday...but a further motion hearing is scheduled for later this month.
